Sometimes, when you have been waiting for a Day for past 2 Years, and when it comes, its true, but surreal.

When querying the E-Courts portal, for details about today’s hearing, as was the ritual for past 2 Years; when the author made the query, the result was “No Records Found”.

The author was bewildered to say the least, and fumbled. Tried once again, and same query.

And then, it strikes, there are options of “Pending” and “Disposed”; since earlier queries were made using “Pending” option; the result was Null. When the Query option was corrected to “Disposed”, the result came.

The feeling cannot be explained.

While “Capital Punishment” was not expected in Danni’s Trial, even though brutality of Crime warranted that; for the fact that, it has not come through is very good for sure.

Because, then the accused Vikat Bhagat would have moved to High Court, to commute the sentence to a lesser term, which would be the sentence which has been awarded to him, today.

That would have meant, the tribulations would not have ceased to for the family & friends of Danni.

Some of the arguments which were forwarded by the author in the last post as on why Vikat Bhagat should never be allowed to walk out alive from the Prison, stood the test of time.

Rigorous imprisonment for life is a sentence of hard labou,r for the rest of a person's natural life.

It's a punishment for extremely serious violent crimes, like the ones which were committed against Danni. Second next to “Capital Punishment”.

Vikat Bhagat has also been sentenced for another 3 Years, for destruction of evidence IPC 201, but the sentences would run concurrently.

He has also been fined petty amounts, despite State Exchequer of Goa having spent huge amounts of money on the trial. Which is also good, else, that would have been also contested, pending the sentence.

While the Defense of accused has prayed for leniency in the Sentence to the Honourable Court, on account of entire trial being based on “Circumstantial Evidence” since there were no eye-witness to either the rape of Danielle or her subsequent murder. The Prosecution has sought maximum sentence, which in this case, would be “Death Penalty”; to be hanged till dead.

The way Vikat Bhagat committed this ghastly crime, in the most gruesome manner; clearly suggests, he is a Physcopath of highest order.

With no remorse to the crime comitted at all, or for that matter not even an iota of guilt of his conduct; his brazenness and total disregard to the law of land and authority had been evident since the moment trial started. Below is just one example, a lot of his “conduct” during his stay in prison has been documented on this publication.

The thing to consider in this Trial’s Sentence is that :

1. Crime indeed comes into “rarest of rare” case, with the psychopathis brutality inflicted on Danielle by Vikat.

2. Vikat Bhagat has shown no remorse or guit for his heinous crime.

3. His conduct inside the Central Jail Colvale Prison has been most horrendous to say the least, with absolutely zero regards to authority or rule of law.

4. In connivance with Central Jail Colvale Prison Officials of Goa Police; he has tried all the tricks in the book, to delay the trial. Much of it has been documented in this publication, in the section dedicated to Danielle.

5. A person who cannot get reformed in just under 8 Years in Prison, or shows not even an iota of “change”, would not get reformed in another 20 Years.

   As his conduct inside the Jail, and his deliberate attempts with the help of Jailors to deny Danielle the Justice has proved.

6. Vikat Bhagat is a Psychopath and shall always remain a Psychopath, if released while alive; given his past life so far, it is given, he would act with total impunity and then there would be another “Danielle”. He is a clear & present danger to all members of Society, till he is alive and not behind bars.

7. Vikat Bhagat is not only a threat to Society and its members; he is a threat to “Rule of Law”; who has absolutely no regards to Law Enforcement Authorities, as demonstrated time & again. He is threat to “Deterrence” of Law.

   It would be an absolute mockery of Rule of Law and the various Courts which have overseen this trial in last 8 years; if he is released alive.

Vikat Bhagat, being alive, is threat to all.

Civil Society.

Law Enforcement Agencies, including Goa Police and,

The “Deterrence” of “Rule of Law”.

How much the State of Goa has expended on his trial, cannot be fathomed; which has been funded through honest tax-payers of the state.

If he is released ever alive; and he commits another of such Ghastly Crime, who would be responsible for the aftermath? The Judge, The Defense or The Prosecution?

Once again, much maligned Goa Police and even much more maligned Jailor(s) of Central Jail Colvale have acted in connivance with the accused (some of the instances have been recounted in various posts here) and failed to produce the accused Vikat Bhagat physically in the Court.

With a IG (Inspector General) Rank IPS (Indian Police Service) Officer, Omvir Singh Bishnoi heading the Prison Department (basically, only one Prison in 2 Districts State), his Juniors have no regards for the rules & regulations laid out under law, let alone, for that matter his authority.

IPS Omvir Singh Bishnoi has been certified by his own staff as DELINQUENT.

The “Judgement Day” was announced well in advance by the Judge overseeing the trial on 7th of February 2015; and this was enough time for beleaguered and extremely malnourished Goa Police, to make arrangements for the accused to be produced Physically, as mandated by Law, on Judgement Day.

But then, Off late we all have seen the glory of Central Jail Colvale’s administration overseen by IPS Omvir Singh Bishnoi.
All you have to do is to make a simple query on any search engine and you would know.

Ironically, BISHNOI is one sub-caste of Hinduism religion, who even protect the deers found in their region, even at the peril of their lives.

But, in a Trial which has been running for now 7 Years, and 7 Months and 9 Days; when it is for culmination; supposedly most compassionate sub-caste of Hindu; the person belonging to it, either had no clue, what is required to be done today; or his Juniors again made a mockery of him, knowing he is of no good and he has no galls to act against them.

What is the use of such IG Rank Officers of IPS Cadre in Goa, where even a Jailor does not give a darn to his authority, forget about an iota of respect, towards him?

Hearing announced 6 Days in advance for “Judgement Order” and IPS Omvir Singh Bishnoi could not even make arrangements for Escort of the accused to the Court?

IPS Omvir Singh Bishnoi should immediately remove his Stars and Collar Patches and flush it down the commode, if he is a REAL BISHNOI; ie if he has any shame left, which is “rarest of rare” in IPS (IndianPolice Service).

What he is doing, and what service of he is to Goa, neither the DGP (Director General of Police) knows; forget about Chief Minister Pramod Sawant, who also heads the Home Ministry, to whom Goa Police reports to.

It’s a matter of just 1 another Day for the Family & Friends of Danielle McLaughlin after almost 8 Years seeking Justice; how efficiently the Colvale Central Jail Administration of Goa Police has aided and abetted the trial to be delayed since last 7 Years, one can read on this publication.

When IPS Omvir Singh Bishnoi, assumed the charge of IG (Inspector General) Prisons, one can just query. And, how efficient he had been, entire Goa knows. At least the Prisoners in Central Jail Colvale, surely knows.

In Hindi Language, there is an eternal saying “Derr Aaye, Durust Aaye”; which basically means, if you correct your course, albeit late, it is well done !

But not for IPS Omvir Singh Bishnoi, who is fond of San Francisco , but not about reputation of Goa. But then, we know, why AGMUT Cadre IPS Officers come to Goa and what they do here. Examples a galore.

One more agonising day to wait for Family & Friends of Danielle McLaughlin, while they are here, for Judgement.

Last, but not the least, this picture goes out to Omvir Singh Bishnoi (IPS) [DEFUNCT], since BISHNOIs sub-caste are supposed to be very compassionate people, they are willing to die even for a deer. This was the extent of injury when, Danielle McLaughlin was found naked in a field at Palolem on 14th March 2017.

Before, we proceed any further, it is very important to read this article published on 29th January 2025.

The presiding Judge which was transferred all of a sudden, seems to have made a come back, and going by the information available; has been instructed to finish the trial and then proceed to next appointment at a North Goa Court.

From 1st of February, the hearing is being conducted again on a daily basis for an extended period of time, as the deadline of 17th February 2025 looms over Trial Court.

After the one year deadline set by Honourable High Court of Goa at Bombay deadline on 17th July 2023; the Trial has seen 3 extensions already; with 17th February 2025 being last and final deadline, allowed by the superior court.

How the trial has progressed since the deadline was issued by High Court on 17th July 2023; bewildering to say the least, you can read here in this section of publication.

Many a time since 17th July 2024, the trial looked to be on track meeting deadline, but then, all of a sudden mysteriously it gets back into crawling phase. In fact, even at June 2024 end, it looked like trial would be over by the deadline set.

Finally, it seems that, tribulations of the trial would be over. But still, what we have seen in at least last 2 Years, with Hopes of the family & friends being crashed time & again, fingers are still crossed.

The term "citation" generally refers to the process of, Lawyers both from Prosecution & Defense, referencing and presenting to the presiding Judge, cases, laws, statutes, and other legal documents, to support arguments and claims made in court.

Lawyers in this part, refer to previous court judgments (cases) that have similar facts or legal issues to the case at hand.

These citations help establish precedents and demonstrate how the other courts has dealt with similar matters in the past.

Proper citation involves providing specific details about the case, such as the names of the parties, the year of the decision, and the court that delivered the judgment.This ensures that the arguments are grounded in existing legal frameworks.

"Citation" help lawyers build strong arguments, establish legal precedents, and persuade the judge to rule in their favor.

With "Final Arguments" and "Further Final Arguments" being over; by all means CITATION would be over either today or tomorrow.

Once, the CITATION is over with submissions made by respective lawyers and questions of the Courts, and further arguments on them; the next step is JUDGMENT to be delivered by the Court.

Hence, it is hoped that Judge presiding over the Trial might announce the "Judgement Day" either today or tomorrow.

Danielle's family (her mother & sister) and friends would be traveling to Goa for the Judgement; and also present at that time would be senior diplomats from both Irish and UK Embassies.

All was going on fine till 7th January hearing of Danielle's trial, and then when matter came up for hearing on 13th January 2025; it was shockingly learnt that the Presiding Judge has been transferred (AGAIN)

By AGAIN, we mean, in just about 2 Months and 15 days.

Last time, She was transferred was on 24th October 2024.

So a simple arithmetic would give you an exact number of dates, till she presided over the trial.

On 24th of October 2024, with reasons known to best to the Turncoat MLA Alexio Sequeira, who also holds the Law &Judiciary Ministry of Goa; several Judges were transferred.

The critical Judge (District Judge - 2 & Additional Sessions Judge) Ms.Pooja Kavlekar was also one of them. This was when, under High Court of Bombay at Goa's time-bound direction; Danielle’s Rape & Murder Trial was under 3rd extension granted by Honourable High Court.

Surely, the antecedents and gravity of the Court Cases (Including High Court Directions) being handled by respective judges would have been considered, but we don't know yet, because in highly progressive and development oriented state of Goa, there are never any surprises. Ms.Pooja Kavlekar was transferred to another Court in Margao Court Complex, South Goa.

In replacement came, Ms.Kshama M Joshi as (District Judge - 2 & Additional Sessions Judge) presiding the Danielle's Rape and Murder Trial.

And now, she has been transferred also; with the trial in limbo and Principal District Judge Ms.Sherin Paul not replying to the Exibit-234 of the Trial Court seeking Danielle's Trial to be transferred to another Court; as there is no presiding Judge.

It has been 15 Days since the Application was made, but Principal District Judge of South Goa is so engrossed with matters of National & International importance; that there has been no revert; and the hearing has been postponed to 2nd February 2025 again; awaiting her reply.

What are the duties and responsibilities of Principal District Judge, is out of scope of this article; but anyone curious enough, can find it out.

The amusing fact is that the Presiding Judge, transferred again in last 2.5 Months (this time to North Goa, at Panjim) has yet to take charge of her new responsibility. She does so only on Saturday, coming.

Good 20 days, after her transfer.

This proves, that there was no urgent need for her transfer. So, then what transpired?

This Alexio Sequeira would only come to know, if he has any grasp on the scheme of things, which he is supposed to improve and correct.

Danielle McLaughlin's Rape & Murder Trial was at start of January 2025, was in "Final Final Arguements"; a trial which has been much in news since its start on 4th of July 2017. Do the Maths.

At such juncture, what kind of emergency emerged that the Presiding Judge had to be transferred, when in matter of couple of weeks she would have finished the trial?

Common Sense, but then;is highly Uncommon in Goa; and Alexio Sequeira is already in his heydays with one leg in Coffin; so not much of is expected of him.

And, we are not talking about any other "Tom, Dick and Harry" like Turncoat Minister Alexio Sequeira; much maligned before being turncoat and now, more so.

Both Ms.Pooja Kavlekar and Ms.Kshama M Joshi are highly acclaimed Judges of Goa, and one can just ask any Advocate practicing in Goa for a couple of years; obviously everyone has Achilles's heel; but ok, lets give them a benefit of doubt.

When defunct Corrupt Police Officers,Government Servants and Ministers carry on for ages because of their political patronage and are of no use to General Public of Goa; how Judges are being transferred at some lunatic and idiot's whims and fancies; without even giving a moment of thought, of the Cases they are handling and at which junctures, are they?

By all means, even a toddler can tell, that this is not an act of "Omission" (though give the fragility of Alexio Sequeira due to his age and thus lack of mental capabilities due to it; we wont give him the benefit of doubt).

So, this looks like an act of "Commission".

By whom? It's a very elementary question.

No one in her/his senses, without being utterly mentally unstable; be it from Bureaucracy or Judiciary would transfer a Judge , who is finishing on an important trial running for more than 7 Years; wherein the Government of United Kingdom and Government of Ireland have made several representations & requests to Chief Minister Pramod Sawant; and he has always lied to them, which amounts to PERJURY.

But, in the tiny 2 Districts State of Goa, with enough money, anyone can be compromised. Along the Coastline and Beaches of Goa, GREED runs DEEP.

When highly acclaimed and critical Judges of the State being transferred in less than 3 Months; like ordinary Pawns (Tom, Dick and Harry), then one can imagine the State of Goa, its Governance and the state of its subjects.

Justice is being diverted willingly in Goa, so that, it could be denied, as long as possible.

Its been 7 Years and 9 Months since the death of Danielle McLaughlin and the Case is still lingering on; despite various promises made by Government of Goa; and several representations made by both Irish and British Diplomats to Chief Minister and Head of Prosecution of the state.

Vikat Bhagat is no ordinary accused. He had a very violent criminal history which was known to Goa Police as a trouble-maker and history-sheeter; having been apprehended in cases of Theft & Robbery earlier,before the Rape & Murder of Danielle McLaughlin.

There have been other Crimes of his which has been discussed online on Facebook Groups, by many Foreign Tourists (one is presented below); which includes grave assault.

Only, if Goa Police would have sent him for long sentence in earlier cases; Danielle would have been alive and happy now. But then...

The recording of the statement of the accused, Vikat Bhagat was delayed, as Defense filed an application for re-examining and recording the Statement of PW43, after recording the statements of all witnesses in the case; which was granted by Judge; finally started on 5th November 2024.

It took exactly one month to record the Statement of accused.

Once he was not produced due to shortage of Escort at Central Jail Colvale and another time; an email was sent by Jailor (who has been very helpful to the accused) to Trial Court that, accused is sick and hence can neither be produced physically or on VC (Without producing any Medical Certificate to that regards to Trial Judge).

This is despite the instructions of Trial Judge to Goa Police Jailor, that accused be produced on every Hearing, in a previous hearing.

The Final Arguments, would start at 1000 hrs on 12-12-2024; where both Prosecution and Defense would put their final arguments and rest their case(s). It is expected to last, for a few Hearings; after which Court would work on Judgement and pronouncement of Punishment.

Since, the extension provided to Trial Court is till 17th February 2025; it is hoped that, Judgement would come before 4th of February 2025; which is Birthday of Danielle.

Today is also, "Human Rights Day" and thus we must reflect on the plight of all those in World and in India; seeking and fighting for their basic moral rights; not only articulated in UN Human Rights Charter; but also enshrined and guaranteed under the Constitution of India.

The process of seeking Justice is an arduous and long process in India and every single Indian is well aware of this fact.

With the Trial, comes its tribulations; trials extending to decades; seeker of Justice has no other way to trot around.

For a Foreigner, seeking Justice in India is far more traumatising; first the rustic and antique justice systems is no way near to that of their own country, wholly unfamiliar territory; and then a very costly affair over the years; with what we have seen not only in the Trial of Danielle McLaughlin but also in the Trial of Murder of Finnish Citizen Felix Dahl, who was murdered in South Goa at Patnem in 2015.

As anxious as the family and friends of Danielle McLaughlin, who were at wits end trying to figure out, why Danielle's trial was back again to a 🐌 snail pace, the senior diplomats from United Kingdom embassy, decided to visit Goa and try to find out the scheme of things, first hand.

3 Senior women diplomats from United Kingdom met with Director of Prosecution Goa, Miss Poonam Bharne in mid of September and were apprised of the fact that, High Court of Bombay at Goa had indeed provided an extension of 3 months for conclusion of Danielle's trial.

The trial which was to end on 17th July 2024, was extended till 17th October 2024.

As written earlier, what was surprising that, the trial virtually stalled after 17th July 2024, after the expiry of original one year deadline.

After another extension was granted, it should have rather kept the same momentum, if not more, so as to keep up with the extended deadline.

State Prosecution along with the Judge were the best entities to grasp the quantum of the work load left to finish. But, instead of speeding up, trial languished badly, after a 3 months extension was granted.

Why, no one knows !

What also came to light that the Judge of the trial court requested Honourable High Court of Goa for a further extension to the already extended deadline.

This request was fastidiously denied by High Court. It was also instructed to the trial court Judge to conclude the trial on or before, 17th October 2024 and that shall include the verdict and Judgement Order also.

Hence, Judge of the Danielle's trial court agreed to hold full day hearings of Danielle's case from 19th September onwards, everyday till the trial gets over.

As the first deadline of 17th July approaches, everyone including the state prosecution was hopeful of finishing it on time. Even the Defense lawyer stated the same in a short sound byte to a local channel then.

These are the people who had the first hand knowledge of the enormity of workload left, and still they sounded optimistic for a closure on or before 17th July 2024.

As two months passed and still the trial was at slow pace, another request was made from the Judge of trial court to Honourable High Court, for another extension, which was denied the same day, when 3 senior woman diplomats from UK met the Director of Prosecution. They were informed immediately, of the same.

The enormity of workload is now sinking in, with daily full day hearings; and it seems, there was just still a lot left to be heard and disposed off by the trial court.

The question still remains the same, if this much of work was to be accomplished, why the hearings almost came to a halt, post 17th July 2024?

If High Court would not have denied the second request of the Judge, with a bare minimum another 3 months extension, the trial would have staggered till year end, bringing another 3 months of anxiety and pain to family and friends of Danielle.

Danielle a dual passport holder from United Kingdom and Ireland, was on a repeat visit to India in early 2017; when on Holi Eve at the intervening night of 13-14th March 2017, she was brutally raped and even more brutally murdered by a local resident Vikat Bhagat at Palolem.

Danielle had gone to southernmost Goa, just for a day to celebrate Holi, from extreme North, where she was training to be a Yoga Teacher.

Prior to High Court's instructions on 17th July 2023, the trial was progressing almost at a Snail pace, which started on 4th of July 2017.

Six years, after every hearing, waiting for another hearing, which were conducted at best to two a month; the trial was not only of Danielle's but also of her family and friends.

Trial picked up great pace from August 2023 onwards and there has been an instance also where, the hearings were conducted on 3 consecutive days, a Hat-trick.

While the trial took the pace, the Defendant and his lawyers tried every trick in the book to delay it, this when, the Defendant Vikat Bhagat applied to High Court for bail in July 2023, pleading that he has been inside the jail for too long and the trial is progressing with very slow pace.

Keenly watching the pace of the trial, everyone who loved Danielle was assured that the Trial Court would meet its deadline of 17th July 2024 of finishing the trial.

So much so that Danielle's Mom Andrea was making plans to visit Goa for the delivery of verdict and judgement.

She also wants to meet the gentleman farmer who first saw Danielle's dead body lying in his field. Since then, he has erected a small shrine in her memory there.

What is notable fact here is that in last 7 Years of the trial, senior Diplomats from both United Kingdom and Ireland have met the Chief Minister of Goa Pramod Sawant and other senior officials of Government, requesting them to fast track the trial, which was promised in 2017.

Everytime a lame assurance was made, but it never happened and finally the High Court intervened, luckily on the bail plea of the accused.

Danielle's trial started on 4th July 2017 and Chief Minister Pramod Sawant assumed the office on 19th March 2019. He has been the Chief Minister, since then.

17th July 2024 came and went away and there was no clarity to anyone whether the one year deadline of the trial has been extended, whether any application respect to this regards have been made by the Trial Court and if so, what is the length of extension, they are asking for?

Usually, when one is working under the instructions of higher authorities to finish the job within a deadline, and see that in spite of their best efforts and due to inadvertent circumstances, beyond their control, they would not be able to meet it; showing respect and sanctity of high office, one shall plea in advance for an extension of the deadline.

But, it seems obvious that in this case it did not happen. Though hard facts were to not come by even middle of August this year.

What was even more mind boggling and utterly distressing for everyone, was that after the passage of the deadline, Danielle's trial was back at the speed of mid 2023. Two or three hearings in a month.

What was again confounding, is that even one misses the deadline, one continues to work with same pace and vigour, so as to finish it as soon as possible, despite missing the deadline. Here, extreme opposite happened. The Hearings of the trial, almost stalled.

The what and why of past two months of court proceedings are still intriguing.

However, in the happiest news of past 14 months since 17th July 2024; very credible sources have confirmed that the trial would end on Thursday, 17th October 2024. No more extension.

After the Ganesh Festival holidays, the trial has again picked up, and is now almost daily. While the trial would conclude on 17th October, the verdict and judgement might take another 7 to 10 days.

Prosecution is very hopeful of a judgement which would deliver justice to Danielle, her family and friends after 88 months of gruelling, agonising and highly stressful trial.

Danielle would be happy, wherever she is and her family and friends are also happy and relieved, sighting the end of a long dark tunnel of trial and it's tribulations.

On 17th July 2023, High Court of Bombay at Goa, instructed the trial court of Danielle McLaughlin trial at Margao Distt & Sessions Court to finish the trial within a year; while hearing a bail plea of the accused Vikat Bhagat.

Following the order, the speed of the Rape&Murder trial increased at scorching pace, with trials being held weekly, then twice a week and sometimes even thrice a week. The urgency and intent to honour the Honourable High Court's instructions was amply visible.

Despite the usual attempts by Defense lawyers to prolong the trial and lapses on the part of Goa Police, which failed to produce the accused on many occasions, due to which the witness examination cannot be recorded; the speed of trial did not relent; with Honourable Judge passing strictures against Goa Police and issuing instructions to North Goa Superintendent of Police.

The pace at which the hearings were taking place, as the deadline of 18th July 2024 approached, despite the hiccups of Lawyer for the accused being absent, Witness not available and Summons not being delivered properly; by all probability, it looked like the trial would be over by July end, and judgement would be delivered by early August, but alas, it was not to be.

The fact of the matter is even the top officials in the Directorate of Prosecution , which is the headquarters of the prosecution in the state, were confident that the trial would conclude by July , with only a handful of witnesses left, including the IOs for the examination. The pace was all set for it, till 18th July 2024; which was the day, when the deadline set by Honourable High Court concluded.

The trial of Danielle McLaughlin started on 4th July 2017 and since then it has been 85 Months. The trial picked up pace, only after the intervention of the High Court; despite several meetings between Embassy and Consulate top officials of both Ireland and United Kingdom, with Government of Goa, including CM.

Now, since a month, after the expiry of the High Court of Bombay at Goa deadline, the speed of the trial has been back to old one, with just about 3 hearings a month.

Even the accused Vikat Bhagat is being produced through VC on these days and there is no update, on the sudden change of pace. It's not known whether the Prosecution has been granted further time, and if so, what is the duration?

It could be possible that, with an extension large enough and only a few witnesses to examine, the pace is consequently leisurely; but the family and friends of Danielle are not sure and hence are very anxious at the moment.

The alarming news is that, from the comforts of Colvale Jail of Goa, some accused of Rape are pressuring the victim to withdraw the case and there is no doubt that the same could have been happening to witness in the other cases too; all because the cases are in a limbo and moving very slowly.

Even in Danielle McLaughlin’s case, there were several promises to fast track the trial, but it never happened and now we are in 86th Month.

The Rape and Murder of Danielle McLaughlin on the intervening night of 13th and 14th March 2017, on the Holi eve, was equally brutal and shocking, the details of which are just too numbing to repeat here again.

While the Trial has speeded up by leaps and bounds, since 17th July 2023 order of Honourable High Court of Goa at Bombay, directing the Trial Court to finish the trail in a time bound manner by July 2024; it seems the accused Vikat Bhagat seems to have resigned to his fate already or trying to prolong the trial, further, again.

On 18th May evening, Saturday; while he was being shifted from one cell block to another; he tried to instigate other prisoners against the Jail Authorities and Goa Police officials. He directed them to block the exit gate of present prison cell, so that he could not be transferred in an orderly manner.

While there is no further information on why he was being transferred from under-trial prison block to another; it could be just routine shuffling by Colvale Central Jail Authorities, or this could be related to rowdy and rogue behaviour of Vikat in the present block, not only with the fellow inmates but also the official responsible for that cell block.

This is not the first time that Vikat has shown scant regards to the rule of law and those who are enforcing it, within the four walls confines of the prison.

Last year, almost during this time only, he was accused of misbehaving with the prison authorities and later accused Jail Officials of beating him up.

While this new twist came up, it delayed the trial for a month or so last year; and invariably this incident of 18th May could be the same trick deployed; as the trial nears to its end.

While the evidence and witness examination is towards completion, the Honourable District and Sessions Court of Margao; would definitely factor in the various incidents of mis conducts and gross disrespect towards the rule of law, while concluding the trial.

The very fact that, Vikat Bhagat was even before the gruesome rape and murder he committed of Danielle McLaughlin was a known History Sheeter and frequent law breaker, has to be weighed in.

He even had the audacity to threaten the Jailor of Colvale Jail with "dire consequences" on 18th May; while time and again, the Jailor and Jail Superintendent has helped him delaying and prolonging the trial, which has been documented well enough on this publication.

There is another Holi coming up in 24th March, this year and tourists are not at all excited about it, here in Goa.

The festival of Holi is celebrated in India to mark the arrival of spring and the triumph of good over evil. It is the most vibrant and joyous festivals in India, celebrated with enthusiasm and fervor across the country.

Why Holi is celebrated and Hindu mythological story behind it, is just a query away, for all those who are interested in it.

However, over the course of recent decades, with the onset of Social Media and the expanse of internet, it has become filthy and extremely dangerous for women, to say the least.

The one day, when people of all religions, caste and creed come together to celebrate the festival of colours; has been reduced to a day, when obscenity of all kinds is supposed to be ok. Besides, their own mother and sister; Holi is a license to grope and molest, any woman for Indian men under the garb of "Bura na maano, Holi Hai".

The ages old adage, which basically was used on those fellows, who were not fond of being rubbed and applied colours, to tell them "Don't mind , after all it's Holi" is now transcended into a credible excuse to commit all the filthy things, specially against women, which otherwise on any other sane day, would be considered a crime.

Danielle had celebrated the Holi previous year too in 23rd March 2016 and enjoyed the revelry.

Being to India earlier, she had a clear idea, about what to expect on Holi, as clearly evident with last communication with her mother Andrea on 13th March 2017.

What happened next, sadly and unfortunately, we all know.

The tourist season in Goa, is almost over, with foreigner tourists seem not at all interested in staying over to play colours on Holi. Those who have not left, are planning to leave before 18th of March, Monday.

Just a decade back, this was unthinkable, as foreigner tourists would plan their itinerary, in a way, which would permit them to celebrate Holi, here in Goa.

Now, after knowing the truth of Holi, they are leaving just about a week or 10 odd days before.

Holi in Goa is perhaps more obscene than any other place, having seen it live, for past many years. Indian men from in and around specially come over to North Goa beaches to touch and grope foreigner tourists women, as if it's their birth right, knowing that they would get away with it.

7 years will have passed tomorrow since we found out we had lost Danielle. 

7 years today since we ever got to speak to Danielle and 7 years today since she trusted her ‘friend’ and it ended up costing her her life. 

We will never ever forgive him for what he did to Danielle that night so instead we will focus on making sure that we will be her voice and that he will never be able to hurt another girl again. 

A lot of you would likely have seen us talk last night on prime time and we were so happy to see how well they showed our Danielle,not the victim he made her, the Danielle we have loved and seen become the incredible woman who would help anyone. 

Danielle could be so innocent and naive yet in the same breath she could become your protector,defender and the person to make you laugh when upset. 

When our daddy became ill while she was in Australia she straight away started googling different trial treatments or anything to help with his quality of life,she called up his doctors to see if there was anything else they could do and then hopped on a plane like it wasn’t the other side of the world she was going to just to make sure she could help us out and be there for him until the end. 

Danielle could have been anywhere in the world it wouldn’t have mattered,if we needed her she would be there. 

She was like a second mother to ‘her girls’ and usually she would always have atleast one beside her when she was in Ireland. 

She was so proud of her girls that the chances are no matter where she met people they always knew about them and their whole life stories. 

Danielle was the proudest big sister. 7 years her girls have went without Danielle. The youngest sister Skye will never truly know Danielle and the incredible person she was,she will never feel her influence which is why as now the eldest sister all I can do is make sure a little bit of Danielle will rub off on her through all our stories and videos. 

Danielle was supposed to be our past ,future and present but because of that monster she has become our past that now all we can do is remember the person she was and think about the person could have been when ‘she grew up’. 

Danielle never felt old and when she realised she was nearly 30 she was so emotional at the thought of becoming ‘old’. 

Due to that awful man she never even got to turn 30 ,she will be forever young now. 

Danielle’s voice may have been silenced 7 years ago but we will make sure her voice will still be heard. 

It has been nearly 7 years since we discovered the sadistic and cruel things he did to Danielle and knowing how she suffered will never stop the pain we feel knowing no one helped her and that she died alone and scared in a foreign country. 

In the space of 2 years we lost a father ,grandfather and a beloved sister/daughter, a grief that most wouldn’t be able to cope with yet we have had no choice but to ‘get on with it’. 

Our grief even 7 years on is so raw because we are still fighting for Danielle and constantly being let down in our fight for Danielle. 

The amount of setbacks we have seen and everything we have heard since her death has been so traumatising and overwhelming yet we are not allowed to let it get to us to ensure we can still fight for Danielle. All we want now is for this nightmare to end and that her killer will finally be found guilty. 

A reminder, however stark, gruesome and difficult to read, is needed on local media, not only for the female tourists, who are still staying in Goa, to be extremely careful and cautious on Holi; it's a reminder for other residents also, that if they see something sinister happening, not to be quiet and dumb like a lamb, but to see, that no harm is done to any other woman.

Right now, as this post is being written to be published; Vikat Bhagat is enjoying the festivities of his sister's wedding today and Danielle McLaughlin is lying 6 feets under, in a cold, dark grave.

Universal Declaration of Human Rights

The Universal Declaration of Human Rights (UDHR) is a milestone document in the history of humanity and human kind.

Drafted by representatives with different legal and cultural backgrounds from all regions of the world, the Declaration was proclaimed by the United Nations General Assembly in Paris on 10 December 1948 (General Assembly resolution 217 A) as a common standard of achievements for all peoples and all nations. 

It sets out, for the first time, fundamental human rights to be universally protected.

The Article 11 of UDHR says : 

Everyone charged with a penal offence has the right to be presumed innocent until proved guilty according to law in a public trial at which he has had all the guarantees necessary for his defence.

Ironically, The Article 11 has been universally cited as a defence by almost all the Criminals who have committed, the most ghastly inhuman crimes, ever witnessed in history. Even those who could be summarily addressed as "Inhuman" and thus cease to have any rights due to the nature of their crimes committed.

Article 11 becomes their shield, under which they try to claim all the concessions and liberties, which otherwise should have been denied to them, for the very inhuman acts, they have committed, which goes utterly against the tenets of UDHR.

Vikat Bhagat is one such Psycopath criminal, taking advantage of it, after brutally raping and murdering 28 Year old Danielle McLaughlin of Ireland.

UDHR also shows the path to us, how to interpret the validity of its Article 11, when the victim's and deceased fundamental human rights have been violated first, by the so called "accused" himself.

Article 3

Everyone has the right to life, liberty and security of person.

Article 5

No one shall be subjected to torture or to cruel, inhuman or degrading treatment or punishment.

UDHR being a path breaking and landmark document in the history of mankind, is also a very intelligent and Commonsense filled document.

There is a reason, why Article 3 and Article 5 takes precedence over Article 11; but still the Lawyer(s) and Psychopath(s) manage to take advantage of it?

But, then Laws are always open for interpretation, usually intelligent and Commonsense ones.

Since, Vikat Bhagat still after 6 Years and almost 8 months is still an accused and not guilty; the Defence and he himself is taking all advantage of his status quo.

But, the most prominent question which needs to be asked is, how Vikat Bhagat managed to keep this status quo?

It's purely because he himself got the trial delayed and prolonged by trying every trick in the book; with the help of his lawyer's and bought out Jail Officials of Goa Police. All these instances are amply documented in the summary and order of trial.

On, 22nd of February 2024, Vikat Bhagat was not produced before the District and Sessions Court of Margao, where the trial is undergoing. He was produced by VC by Jail Officials, but Internet Connection was down and hearing has to be adjourned.

Justice could be blind, but Justice could be prudent also.

Jurisprudence is a word we don't hear often, because for some reason. And the reason, just like laws, is open for interpretation of all.

Danielle would never get married. Danielle would never be able to attend her sisters wedding.

But, Vikat Bhagat is still merely an "accused" and hence has his rights under Article 11 of UDHR.

Vikat Bhagat first moved the bail application at the District and Sessions Court of Margao, where the trial has been going on for past 6 Years and 7 months almost now.

Presiding Judge Her Lordship, Smt Kshama Joshi rejected the application of Vikat, citing Honourable High Court's order of July 2023; while hearing another of the accused' s bail application. The order was passed on 9th February 2024.

Vikat in another attempt, is trying to pull a Kuldeep Sengar at Goa.

Kuldeep Singh Sengar a politician, was expelled from the Bharatiya Janata Party (BJP) in 2018 after being convicted of raping a minor girl in 2017.

In 2023, the Delhi High Court granted him interim bail to attend his daughter's wedding. This decision was met with criticism from many, who argued that it was inappropriate to allow a convicted rapist to be released on bail for any reason.

Sengar was sentenced to life imprisonment for the rape in 2018. He was also convicted of the custodial death of the victim's father, and sentenced to 10 years in prison for that crime.

The Delhi High Court's decision to grant Sengar bail was based on the fact that his daughter was getting married and that he had promised to return to jail after the ceremony.

However, common people felt that this was not a sufficient reason to release a convicted rapist, and that Sengar should have remained in jail.

Danielle McLaughlin was the eldest of 6 daughters, who affectionately used to call them "My Girls".

Danielle could not attend the wedding of any of her sisters and shall never be able to do so.

She was so brutally murdered, that her sisters could not even take a good look at her face one last time, as her face was disfigured by smashing it with beer bottles.

The same person who is on trial for such a ghastly crime, beyond human reasoning, is now asking to be released to attend his sister's wedding? While the accused and his lawyer have the right to move the application; the whole absurdity of it is hilarious.

And it's not such that the conduct of Vikat Bhagat has been exemplary during this trial, which has been prolonged due to his and his lawyer's Dilly dallying tactics, taking the full advantage of legal loopholes.

How gross his conduct has been during this trial, is mentioned in the 9th February 2024 order of District and Sessions Court of Margao.

The lawyer of Vikat would have argued that being the lone son in the family, it is necessary for him to be present in the absence of his father.

While the fact is that, while committing this ghastly crime, he did not even once thought about his family;  what kind of eternal shame, pain and anguish it would bring to them. Now, applying bail in compassionate grounds.

Danielle also wanted to attend wedding of all her sisters, but this right of hers was snatched away in the most brutal manner, beyond any comprehension.

Now, why this opportunity should be provided to the accused of her brutal rape and murder?

Vikat Bhagat going by his history even before March 2017, was a Psychopath.

With his conduct, with Danielle McLaughlin, he amply proved that fact again.

Trying every trick in the book to delay and prolong the trial, much to the anguish of victim's family and friends; the Psychopath is trying to seek some leniency from the High Court, again.

One who had no fear of the rule of law while outside prison, and continued to make the mockery of law enforcement and judicial system while in custody; is seeking interim bail on compassionate grounds?

Did you hear of a better joke, this February?

Danielle had rights too.

Right to live.

Right to be treated with dignity.

Right for justice.

Where are the rights of Danielle McLaughlin and what happened to them?

If this interim bail happens, it would be butt of a joke eternally and people would lose the faith in Indian judicial system, not only in India, but abroad also.

Psycopaths who try to rule over law enforcement and judicial system with the power of money by buying out Goa Police Jail Officials and others; hiring lawyers who try everything in the book to prolong the trial; should not be let out.

Just Like Rabid dogs.

Instances where an accused on trial for a brutal rape and murder case has been granted bail to attend his sister's wedding in India are extremely rare, if not virtually nonexistent. 

Courts typically prioritize public safety and the seriousness of the charges when considering bail requests, especially in cases involving violent crimes. 

Vikat Bhagat was granted interim bail once already at the demise of his father. Being a lone son, it was his duty to cremate his father, as per Hindu customs. But attending his sister's wedding is a totally different scenario. 

Granting him bail in such circumstances would likely be highly controversial, in the absence of compelling and exceptional circumstances.

Danni in her 28 very short years, travelled long and wide. Almost entire Europe and all the "known" places in Asia.

Been to Australia a couple of times, Canada was on her mind, when she set off for Goa on 21st February 2017, from her home Buncarana, Ireland.

Travel was ingrained in her, from the very stint in the womb of her mother. Her mother Andrea, travelled to Glasgow, Scotland to be with her relatives and Danni was already so itching to explore the world, she was about set foot in, that she could not wait, more 5 weeks.

Danni arrived in this world yesterday, 35 Years ago at 1800 hrs, local time.

Danni being the first of her kids, Andrea decided to name her on her cousins, whom she was very close to, being a single child and no siblings.

And thus, the Ginger haired baby, her first was named "Danielle Marie Teresa McLaughlin.

Danielle is the cousin of Andrea, Marie is sister of Danielle and Teresa is Andrea's mother.

Living true to one's name is easily the biggest accomplishment one can achieve ; Danni was Mary to her young sisters and Teresa for a lot of teens and under-privileged.

As this post is being hand written on the same beach, where Danni once walked just about 7 Years back; a few toddlers and babies are frolicking in water with their mothers, enjoying the sea.

Danni would have also witnessed this adorable spectacle years back and thus her resolve to help teens, who have lost their path. Being herself, the eldest of 6 daughters, a guardian to "her girls"!

Danni went to "Scoil Losagain" and "Scoil Mhuire" locally at Ireland.

We need not discuss her academic bent, because it is amply visible later.

Danni enrolled in "Northwest Regional College" at Ireland, to finish her Bachelor's.

John Moore University of Liverpool was her choice to pursue her Master's in " Criminology and Psychology ".

When we hear about Liverpool or read, the first thing which comes to mind is "You will never walk alone!". Made famous by Gary and Pacemakers and later adopted as motto and anthem of Liverpool FC.

Perhaps it was a very easy choice for Danni to pursue "Criminology and Psychology" in a city, which lives by "You will not walk alone".

Apart from her choice of the place to pursue her Master's, Dani's choice of her subjects and later her work in the same field; gives a glimpse of the caring and compassionate soul she was. 

She could have interned anywhere, but chose to work as a "Social Worker" for teen criminals during her studies. Trying to dive deep, in to their psyche and try to bring them to right and honest path.

Before her (final) adventure as she called and her travel to Goa and India, Danni was in Goa in 2016 as well.

She worked at an Orphanage of Mother Teresa for six months.

She would have probably stayed longer but the illness of her father and thus the solemn duty of as the eldest child, brought her back to Buncarana, Ireland. 

For Danni, it was just another hop, from one "moral duty" to another. It would only take an Orphan to understand the compassion and kindness of a soul like Danni.

Danni came back to Ireland, taking care of her ailing father and helping her mother Andrea with daily life and lives of 5 other girls.

Unfortunately, Danni's Dad passed way in November 2016. 

Just 4 months after, Danni was forced to leave this world too, in a very brutal manner.

Bereft of words trying to comprehend the sorrow of a tight knit family; which had another tragedy, not long before.

Contemplating over her future course of actions, after the twin tragedies in quick succession, Danni was in two minds.

To follow her dream of being a Yoga and Irish Dance teacher for a while, till she decides, she is good enough to settle down with a proper job and family; or to start working at Liverpool, taking care of "her girls" , performing her duty as eldest child.

Sensing the intense predicament which Danni was going through, Andrea her mother, urged her to follow her dreams, despite being onerous "work" of raising 5 girls, the oldest of them , 25 now, as a single parent.

She would have requested Danni to stay back, but instead, Andrea supported Danni's dreams. The happiness of all her kids, has been always supreme. Happiness of Danielle, her first kid, came first and always.

Danni's plan was to enroll in a "Teacher's Training Course" at a very popular beach at North Goa, which has ample such "schools". Finish the course and then embark to Canada, where a lot of her friends were waiting for her. Her plan was to teach Yoga and Irish Dance to youngsters, as well as kids.

For an adventurous soul like her,  Canada, where she has not been earlier before; the call of the Rocky Mountains and the wilderness it affords to explorer souls, was too difficult to miss.

Canada was her final destination, that's where she wanted to settle down.

 Anyone who is adventurous and exploring, would agree with it. Just across South, the enchanting adventure of amazing trails of PCT, JMT and Appalachian Trail waited for her. And, are still waiting.

Danni left her home at Buncarana, Ireland for Goa on 21st February 2017.

She had no clue, in less than 3 weeks, she would be brutally raped and even more brutally murdered, in the very land, she decided to came back; in spite of the twin tragedies befalling her in quick succession.

She came to Goa to heal, would not be exorbitant statement, considering the free souls, this land has attracted due to its diverse cultures and kind people.

Danni's final days in this world and Goa, was on the eve of Holi.

She came to Palolem at the insistence of a female friend, while still enrolled at the Yoga School, focussed on her dream and future.

Arriving at Palolem, Canacona, South Goa from Mandrem Constituency; which is extreme North of Goa, to have a day off.  She arrived on 12th March 2017 and was found dead in 14th March morning.

Her plan was to move back to North, on 15th March 2017 and resume her Yoga and Meditation classes.

Holi is not only the festival of colours , but also a festival of dance and music. Being a good guitarist and practitioner of Irish Dance, the music and dance of Holi, appealed to her, to take an unusual break from her classes.

What happened next to Danni is known is known to all.

Like most of the foreign Tourists coming to India, Danni had been to Nepal also. But when, earthquake striked there, she volunteered to build the damaged houses and schools, doing her bit as a "responsible tourist". Else, she would not have probably faced "her girls" proudly.

How much Danni was loved all over the world, due to her kind and compassionate nature and her travels could be gauged from "reactions" to one of her SM post, announcing her next adventure, not knowing , that it would be her last.

Most of Danni's childhood friend, still live close by. Some have relocated to other parts of this planet; but still remain in touch with family and relish the gentle and vivacious soul , they knew. They still know.

Enthralled by nature and the rise it lead to her compassion, Danni turned a vegetarian; after one of her visit to Australia. Not being able to resist to Cheese, which she loved so much, she would have otherwise being a Vegan, by now.

From someone who loved to hook-line-sinker, the transformation speaks aptly, about how her travels, made her so much of a better person.

Natty, an Irish singer was her favourite artist and singer of all; and she would would always coax her friends to come along with her, if there was a concert if him, being staged nearby.

Natty, sang at her funeral as the ultimate tribute to his most ardent fan.

What you would make out, of Danni, if you come to know that she named, the middle name of one of her younger sister "Victoria Beckham"?

Danni's youngest sister who was barely 3, when she left for her final explore, still fondly remembers her. The one who took her to Disney's movie Moana and their regular escapades for a "Hot Chocolate".

A "Gypsy Dancer" , Danni started participating in "Irish Dance" competitions from a very early age.

Had, Goa not been her destination in February 2017; many kids and youngsters would have had the privilege to learn from not only an apt and able teacher, but perhaps the most compassionate one.

This would not be an over statement that, Danni treated everyone as "her girls"; the way he treated her five siblings. Caring and compassionate, always.

Her family and friends, would gather at at her grave to remember her, followed by the Mass in her remembrance, on this 35th birthday. There is no better way to honour Danni, than to indulge in a fun and adventurous activity. 

A lot of tears would flow down over anecdotes and shared stories, over dinner.

Today, we honour, Danielle Marie Teresa McLaughlin. This world is a better place, in the short time, she graced it.

Itching to get on the exploration again, we might have a chance encounter with her, as one another kid, somewhere on this planet.

Since the High Court's Direction to the District Court of Margao, on 17th July 2023 to complete the trial of Danielle McLaughlin Murder in a time bound manner, within a year; considerable progress has been made. The number of hearings has increased a lot.

While the progress is good since then, Irish and British Diplomats continue to remain engaged with each other and Indian authorities in Goa, regarding the trial, in order for a fast conclusion of the trial.

On 4th July 2024, it would be 7 Years since the trial started.

During the meeting with British and Irish Diplomats, Additional Secretary Mr.Anthony D Souza apprised the Ladies and Gentlemen present, of the progress and the commitment of authorities in Goa, towards an early conclusion.

Mr.D Souza showed sensitivity and awareness towards the current situation of family and friends of Danielle McLaughlin, who have been now waiting for more than 6.5 Years now for the justice to be delivered to Danielle.

Every hearing of the trial is an anxious day for the family of Danielle, of which 234 have taken place. The 234th Hearing took place yesterday.

There was also a high level meeting between the Irish and British Diplomats to discuss Danielle's case, among themselves, as in how they can further the cause and bring it to conclusion, faster among themselves.

The meeting involved the Trade Commissioner and Deputy High Commissioner of United Kingdom. Consul for Bhutan and India of UK. Head of British Consular Operations : Western India and other Diplomats from British Deputy High Commission in Goa.

The positive sentiment which emerged was that good progress has been made in last 6 months and that they would continue to remain highly engaged in the case and also continue to work hard on it; raising the issue at every opportunity moment available; in order to see it through that justice is delivered to Danielle soon.

While the trial is "State v/s Vikat Bhagat" ironically most of the impediments in the trial is due to the lethargy, insensitivity and lacdaisical unprofessional attitude of personnel of Goa Police. And others are just legal technicalities which the Defence has made good use of.

While the trial has seen less insensitivity on part of Goa Police, since High Court's ruling last July; but still lot to be desired on their part so as that trial can be expedited.

This has been discussed many a times before in this publication.

Ironically, an elongated trial is good for no one.

The State's resources are wasted on the trial, both material and human.

Now with a time bound direction from Upper Court, the hearings of Danielle's case has increased; which basically means the hearings of some other cases would have been reduced considering the limited legal resources and constant increase in number of legal cases.

The adjournment or delays in hearings of other cases due to fast tracking of Danielle's trial would not only aggrieve those fighting for justice in other trials pending at the District Court of Margao, but also puts a lot of pressure on trial Judge to balance out everything.

In just about 180 days, 28 Hearings of the Trial has concluded; which is a very high number considering the past precidence, prior to 17th July 2023.

This is despite the long festival breaks of Ganesh Chaturthi, Diwali and Year end Breaks. Else, the number of hearings would have been much higher.

Not only the number of hearings increased considerably, the seriousness in the business being conducted has also so.

While there has been usual hiccups and deliberate attempts by Defence to delay the process further, as evident in yesterday's summary; still it is so much better

The presiding judge has been acting very strict, in any lapses on part of Goa Police personnel, whether it be delivering summons or not presenting the accused in front of the court for the hearing.

All thanks, to the intervention of Hon'ble High Court of Bombay at Goa.

6 months have concluded since the direction issued by Honourable High Court and 6 more left.

While there is still a lot of work to do and finish, in a time bound manner as directed by Upper Court and the presiding judge of the trial has been emphasising and focussing on it, in almost every hearing.

With no more long vacations till summer break, the trial of Danielle McLaughlin is expected to take a faster turn, and shall most hopefully finish by the deadline set by High Court which is 16th July 2024.

Luckily we have a day extra this year, on account of Leap Year.

Daniele's trial has seen several changes now so far; due to the prolong period of more than 6 Years now.This year itself, the Judge and Court hearing the trial has been changed thrice; the most immediate one, notified yesterday itself.

While a short while earlier Smt.Pooja C Kavlekar was the Judge for a short period of time; later Smt.Shabnam S Shaikh presided over the hearings of the trial and now Smt.Kshama Joshi is the new Judge of Danielle's Trial.

For the last 18 months almost, the trial of Danielle has been languishing in the Court of an Adhoc Judge; with Judges being changed every now and then; much to the anguish of the Victim and Victim's family; while bringing a lot of solace and reprieve to the accused.

It is to be noted that, Danielle's gruesome murder, and rape before that; was supposed to be fast-tracked by State, who is the petitioner.

An ad hoc judge is a temporary judge appointed for a specific case or a limited duration to assist in the proceedings of a court, especially in situations where the regular judges might be unavailable or where there is a need for expertise in a specific area of law.

The appointment of a permanent Judge after the High Court verdict, is a very welcome move, in a positive direction. While the Judiciary has moved in the right direction. Goa Police is yet to move.

Colvale Central Jail Jailor, has failed to produce the accused twice, in the last 3 hearings again. At 206th Hearing, again a Wireless message was received that accused Vikat Bhagat is sick.

Yesterday,again the accused was not produced for the 208th hearing of the trial; while no reason whatsoever was produced before the Hon'ble Judge; forcing the Judge Smt.Kshama Joshi to issue a "Show Cause Notice" to the Jailor, as in why the accused was not produced before the Court.

While the Jailor of Central Jail Colvale in the past all flimsy accuses, and the Wireless messages are received at the last moment always,on the day of hearing; this time, there was not even an "excuse". This is despite the High Court ruling on 17th July, to finish the trial in 1 Year.

Also,ironical is the fact that, bail plea by the accused due to which, the ruling of HC was issued; was based on the fact, that trial has prolonged much; and accused should be temporarily excused, due to that.

Now, Vikat Bhagat with the help of Goa Police officials at Central Jail Colvale; is doing the same thing again, prolonging the trial with one excuse or other.

On 16th August; the Police Inspector Rajesh Job (Investigation Officer) too failed to appear before the Court.There was no reason cited for it.

It's one month since HC Judgement; and neither the accused is produced regularly,nor does the Investigation Officer appears.

11 months, more left.

Hardly any business has been conducted of substance since 21st Jul 2023, in the last 3 hearings.

In a scene from the iconic and most famous Hindi movie SHOLAY, the newly appointed Jailor of the Central Jail, admits how his ways are incorrigible; and so are the ways of Prisoners. The absolutely pathetic conduct of Central Jail Colvale Jailor, rhymes perfect with it.

A very unexpected occurrence was also, that accused Vikat Bhagat was produced in the court by Goa Police,this when Legislative assembly in session, along with G20 ministers summit and incessant rains lashing the state.

All this was not happenstance. It all happened, after the ruling of Hon'ble High Court of Bombay at Goa, instructing the Trial Court, to conclude the trial within a year on 17th July 2023..

This brings to forth many questions, specially about Intent and Capability.

Let's first discuss the Capability of the Judiciary system and Goa Police.

While Judiciary is severely dependent on Law Enforcement, for smooth and fast conclusion of trial; Goa Police had been almost siding and protecting the accused, with a lot of preferential treatment; the prosecution failed to question the largess given to accused by Goa Police.

While the Goa Police failed to get the summons served, returned and Witness available for hearing; time and time again; Prosecution and State failed to brought it to the notice of Hon'ble Court; the delay tactics, due to which the Trial has languished for more than 6 years now.

All this kept on happening, despite the promises being made to fast-track the trial; the representations being made by senior diplomats of both Ireland and United Kingdom, as Danielle held dual passport.

Notwithstanding, the gravity of crime; it's gruesome and heinous nature; which has since then certainly brought a A LOT OF SHAME TO GOA; and it's famed Tourism.

If the bail application would not have been made by accused Vikat Bhagat at High Court; and High Court would not have made a stricture and set a deadline, things would not have moved so quickly.

So, while so much can be achieved in one hearing; Capability or the lack of in fact, is not the question any more.

So, Intent?

Why there was lack of intent on the part of Goa Police and State Prosecution to conclude the trial quickly ad get the victim and her family&friends swift justice; is just an easy guess for anyone.

As, evident in the Felix Dahl Murder Trial; the nepotism displayed by Goa Police has been at fore, in this case too. The state prosecutors who handled the case earlier, are equally to blame; for showing absolute lack of intent.

This is when,accused had confessed of the crime; is a history sheeter; and also confessed to another sexual assault on a Scottish female tourist, which was verbally complained to Goa Police; but cognizance of the same was not taken.

The intervention of High Court happened, only due to providence.

Goa has seen 43 Rape cases in last 6 months itself; and a total of 119 Crimes, including 40 cases of molestation and equally shocking 24 Kidnappings. Out of the 43 Cases of Rapes in last 6 months, Chargesheet has been filed only in 20 cases.

Such providence would not happen with every other victim; or if it has to happen; it would take a lot of gestation with stroke of luck; till then victim and their family&friends would have to suffer.

Now, Danielle and her family & friends HOPE that the trial continues in the similar fast-track manner; since incapability of Goa Police and State Prosecution is ruled out; and the Hon'ble High Court has set the "Intent" right.

Paul Caldwell, a childhood friend of Danielle McLaughlin, sings in the memory of Danielle; a song which sums up the emotions and feelings of Danielle's family & friend; and everyone whom she touched, directly and indirectly.

99Goa published the 1st Post on Danielle McLaughlin trial on 17th March 2023, exactly 4 months before the High Court judgment yesterday.

Since, then tracking the trial persistently, it has been 13 articles so far; and this is the 14th one. A sweet one indeed.

While it has been often said that Law is Blind, certainly Judiciary and Judges are not blind; at least in most of the cases.

While the accused and his lawyers tried every book in the trade, to prolong and delay the trial, so that thy can move for bail, on the grounds of protracted long trial;the Hon'ble High Court was able to see through the modus operandi completely.

The bail application which was moved by accused Vikat Bhagat has also been dismissed.

After 6 Years of anguish and pain, it's finally some positive news for the family& friends and the victim herself.

Everyone wants this trial, to be over; and despite the fact of initial confession of accused, that he murdered Danielle, in the most gruesome way, one can't even imagine; this trial has been languishing for more than 6 Years.

Summons not served;
Summons served but witness not appearing; 
Witness asking for more time to be available on medical grounds; 
Accused not being produced; 
Defense Lawyer not being present; 
Accused,accusing Goa Police of assault and harassment; 
Defense fighting for the "rights" of the accused, but forgetting about the rights of the victim; 
Hearings being held at almost 3 weeks interval during the period;
Accused moving bail application, time and again; there is a long roster of things.

After 6 Years, the maxim "Justice Delayed, Is Justice Denied" still holds true in Danielle's trial; but at least there is a light at the end of the tunnel, finally. One year away, but still, the ray of hope can be seen.

Accused Vikat Bhagat needs to be served an exemplary punishment for the 2 grave and heinous crimes which he committed against the victim; the rape and murder.The trial court should see that, there is no "Vikat" rises his monstrous head ever again in Goa.

Ms McLaughlin grew up in Buncrana, County Donegal, in the Republic of Ireland.She also held a British passport and studied earlier at Liverpool John Moores University.

She arrived in Goa in February 2017,and was brutally raped and murdered on Holi eve, on 14th March 2017.

While, the accused Vikat Bhagat confessed to the murder of Danielle, just soon after; and the trial was supposed to be fast-tracked, it's been 6 years now.

The details of how Danielle was dealt with in her last moments by the accused Vikat Bhagat, can be found by just a cursory search, it's too heinous and inhuman to mention it here.

If Losing a family member, in such a horrible and unexpected way was not enough of a tragedy to deal with; for the family and friends of Danielle McLaughlin; the tragedy has been unfolding every 21 days or so, since last 6 Years.On a new hearing date,the tragedy unfurls repeatedly as the hope is crushed.

Every new hearing date brings back to the fore, the pain and anguish of the sudden tragic death of Danielle in the minds of family and friends. It's like revisiting the horrors and the monster, again and again, every 3 weeks; with no respite seen coming.

Over a period of time, time heals every pain; but how the healing of Danielle's family members can happen, when the pain comes back, every 3 weeks or so.

Judge has been changed, Public Prosecutor has changed; but unless the state government of Goa, decides that enough is enough; the horrors would continue to unfurl.

Chief Minister Pramod Sawant, who now boasts of one of the longest serving Chief Minister of Goa, came into being as a Chief Minister on 19th March 2019. Just about 18 months since Danielle's trial began.

Time and again, presentation to him is being made, to fast-track the trial by the senior diplomats of both Ireland and United Kingdom.

Ironically, he has a teenage daughter too.It is expected from a father of a teenage daughter, to see that tears of another mother stop flowing every 3 weeks. The mother of a daughter, who loved Goa so very much; and probably the love of Goa took her life.

The next hearing of Danielle's trial is scheduled on 7th July 2023,Friday coming.

Sometimes the accused is not produced from the jail, Sometimes the defense lawyer is not present, Warrants served but witness do not present, Inspector General of Police does not reply to Courts order on time.The agonies of this 6 year old are just too many to mention.

Danielle's rape and murder trial is not just about her friends and family members only, it's about Danielle first. A tourist who came to Go, because she loved the state and everything that the state had to offer; but the brutality of few people here, costed her life; and is now costing her "Justice".

Danielle is not here to answer the question personally, but if she would have been asked, do you still love Goa?; The answer would still have been unequivocally "Yes".

The longest murder trial in Ireland is the trial of Catherine Nevin. Catherine Nevin was a prominent figure in the case known as the "Black Widow" trial, which involved the murder of her husband, Tom Nevin, in 1996. The trial began in October 2000 and lasted for 42 days. Catherine Nevin was ultimately convicted of murder and sentenced to life imprisonment.
