A World Record : Anti-Corruption branch of CBI India, conducts homicide investigation and closes it after 5 Years.
Lack of evidence cited. Truth: Lacking Will & Intent of a proper investigation. Questions a galore.
When starting a re-investigation in a murder case, the most important thing is to approach the investigation with an open mind and a commitment to uncovering the truth, regardless of any preconceived notions or biases.
Central Bureau Of Investigation (CBI) investigates Felix Dahl murder case, for 5 Years, and files the closure report with JMFC Canacona court, that investigation has been closed due to "lack of evidence".
The investigation or the re-investigation was necessitated in the very first place, because Goa Police acted with a malafide intent. First not registering a case of Murder (Felix's family had to go to court, seek legal intervention) and then when, even after the case was registered, Goa Police maintained that, it was an accidental fall.
Hence, if the will and intent of the CBI investigation was to uncover the truth; and look with an open mind; the outcome would have been far way different. The apprehensions casted by not only local court JMFC Canacona, but also the High Court Of Bombay, towards the investigation; are some very good starting points.
But,there was never the will or intent of the investigaton, to get to the truth.
If the will and intent is there, then it does not take 5 Years to conclude "lack of evidence".
Was there a thorough review of the original investigation?
Ideally,this involves looking at all the evidence and documentation from the original investigation, including any witness statements, forensic reports, and physical evidence.The second autopsy report done in Finland. The circumstantial evidence. The common-sense, how can someone manage to hurt his head 5 times at the dead of night, at an isolated place?
Was re-interview of witnesses done?
Who may have new information or insights into the case.Locating and re-interviewing witnesses who were interviewed during the original investigation.Those who might have acted under duress earlier, due to influence of local Police and accused, who has a wide criminal background.
Did the CBI Investigators identify and interview any individuals who may have had a motive or opportunity to commit the crime? This includes the prime accused. For Goa Police, there were no usual suspects, in spite of strange and very suspicious behaviour of the accused leading to the death of Felix Dahl.
While the family of Felix Dahl waited for 5 Years, for the investigation to be completed, it seems the investigation lacked any kind of supervision. Officers were changed routinely, there was no anchor investigators.
If an investigation is not progressing satisfactorily, instead of putting it in the limbo, there are ways and means to fastrack it. After all, CBI does not have a dearth of good and competent officers, who can crack a murder case.
This shall be the World's only murder investigation, which was conducted by Anti-Corruption Branch Officers of a premier investigation agency and not homicide experts. Why?Because, there was never an intent to get to truth. The corrupt Police Officers of Goa Police,Prashal Dessai and Filomeno Costa had to be protected. And they are still serving in the force, and even got promoted.
And Felix was not the first, and not the last to be murdered, without any justice done.
When the State Of Goa, cannot ensure neither safety nor justice, for the tourist victims, it is highly probable to say that, only foolhardy and daredevil foriegners (excluding Russian and Israeli, because they are not liked elsewhere) would come to visit Goa in future.
